SUMMARIES OF SELECTED LITIGATION SUPPORT ENGAGEMENTS - BANKRUPTCY SERVICES

Investor Claims 
SKC was retained to assist in the reconstruction of approximately 4,000 investor claims involving a variety of business structures where the investor proceeds were invested in numerous real estate investment and development activities.

Reconstruction of Accounting Records 
SKC was retained to assist with the reconstruction of accounting records related to tracing of lender monies to acquire and remediate a 1,000 acre parcel of contaminated land through a series of related entities. The firm assisted management in a variety of capacities in numerous legal actions.

Derivative Action
SKC was appointed by the Court to an Independent Panel to investigate the derivative allegations in a complaint related to a family owned business in bankruptcy to determine whether the derivative proceeding was in the best interests of the company. We reviewed checks written by the business over a three-year period to identify all payments made to family members and determine the propriety of such payments. We reviewed corporate minutes and other documents, interviewed family members and ultimately rendered an opinion regarding whether it was in the company’s best interests to pursue the claims made against family members.
